2. TERMS OF USE OF OUR SITE
2.1 Please read these Terms of Use before using our website. By accessing and using our site, you indicate you accept all clauses, terms, and conditions contained in this Terms of Use and agree to abide by them. If you do not agree to any one or more of these clauses, terms, and conditions, please cease usage of our website.
2.2 We reserve the right to amend, revise, or change these Terms of Use at any time.
2.3 We reserve all rights to intellectual property including but not limited to, photographs, images, logos, and designs.
2.4 We note any breach of intellectual property may be subject to legal action.
3. ORDER CANCELLATION
3.1 We reserve the right to refuse service to any user or cancel an order at any time without explanation. Refusal of service or order cancellation may be due to (but not limited to):
- Unavailability of listed goods
- Error in listed sale price of goods
- Error in final sale price of goods
- Unauthorised use of discount/promotional code
- Error in description of goods
3.2 All cancelled orders are entitled to a full refund pursuant to clause ‘3.4’ of these Terms of Use
4. RETURNS AND REFUNDS
4.1 Returns Policy
4.12 In furtherance of our commitment to customer satisfaction, we offer returns on all orders placed through our website subject to the following conditions:
4.13 All returns must be initiated through the ‘returns and refunds’ form accessible through the website within 30 days of your order.
4.15 Once a return request has been initiated, you will receive email confirmation informing if your return request has been approved or rejected.
4.16 If your request is approved, you will be advised to return the goods to a nominated postal address via Australia Post. A tracking number must be provided within 7 days of an email indicating return approval or your return will not be accepted.
4.17 Unless defective/faulty under term 5 The Boot Chef will not be liable for any costs or expenses incurred in returning the goods.
4.2 All returned goods must: be in identical condition as originally received and include all original packaging, tags and merchandise.
4.3 Refunds
4.31 Refunds for returned goods will be processed within 5 business days to the payment method used to originally purchase the goods. Funds may take 24-96 hours to be accessible once a refund is processed.
4.32 Refunds for cancelled goods will be processed contemporaneously with the cancellation of an order to the payment method used to originally purchase the goods. Funds may take 24-96 hours to be accessible once a refund is processed.
5 FAULTY/DEFECTIVE GOODS POLICY
5.1 The Boot Chef’s wide range of available products often includes older, discontinued models of football boots. Age may cause the material, gluing, and structure of older boots to deteriorate and compromise the durability of the boots if worn.
5.2 We take our obligations under the Australian Consumer Law seriously. The purpose of The Boot Chef Football's faulty and defective product policy is to allow the sale of collectors items.
5.3 In consideration of clauses 5.1 and 5.2, The Boot Chef will honour claims for defective/faulty goods manufactured within 3 years of the original date of sale.
5.4 Please refer to the individual product listing to find the manufacture year on any given boot. The manufacture year is determined by inspecting the information tag on the product and can be found on the product listing.
5.5 The Boot Chef may offer compensation limited to the full amount of the original purchase if goods are determined to be defective or faulty.
5.6 The Boot Chef reserves the right to defer to the manufacturer of the goods in question the determination if the goods are faulty/defective.
5.7 Standard postage costs incurred returning defective/faulty goods will be reimbursed up to $18.00 AUD.
6 ORDERING
6.1 Customers are responsible for entering accurate and complete information when placing an order. The Boot Chef will not be liable for lost or undelivered packages due to inaccurate and incomplete shipping or billing information.
6.2 Prices and availability of listed goods are subject to change without notice.
6.3 Payment must be made in full at the time of ordering.
7 SHIPPING AND DELIVERY
7.1 Orders will be shipped via Australia Post, Sendle Parcel Delivery or other like service within 30 days of ordering.
7.2 The liability is wholly on the customer/receiver of the goods to pay customs, duties, or any additional taxes. Please check the customs duties and import fees for your jurisdiction before placing an order.
